Using fuzzy cognitive modeling to assess the effectiveness of the judicial system

The effective functioning of the judiciary influences the level of social value of the Constitutional Declaration on judicial protection of the rights and freedoms of the individual. Well established, efficiently functioning judicial system is the basis of the stability of the state. The more effective it is, the less social tension in the society. Evaluation of the effectiveness of the judicial system is carried out to determine whether the real effectiveness of this system is a perfect view of it. Identification of inconsistencies justifies the necessity and the ways of .the judicial reform. The complexity of creating the techniques to assess the effectiveness of the functioning of the judiciary system concerns the fact that, on the one hand, the judicial system is a loosely structured, because the relationships between its elements are often blurred and are difficult to formal description. On the other hand, when evaluating the performance, not only the factors that have explicit numeric characteristics, but also the factors that are difficult, and often impossible, to express a clear value in plain number (for example, the degree of confidence in the judicial system; the level of satisfaction of the population from functioning of the courts or an individual judge; access to justice; the degree of independence of the judiciary and the impartiality of its judgments, etc.) should be taken into account. The proposed in the work methodology is based on the application of the theory of fuzzy sets and allows to take into account the specifics of the considered problem.
